Sky-lab Retreat Participation Agreement 2026

RETREAT TERMS AND CONDITIONS

PAYMENT POLICY

To reserve a spot on a Sky-lab retreat, a non-refundable deposit of $850.00 AUD for Resort Room bookings and $950.00 AUD for Beachfront Pool Suites is required upon registration. Full payment (the balance) must be made 120 days prior to the retreat start date (April 19th, 2026). Prices are based per person, twin share (share with another retreat guest or friend) or king / queen solo rooms where specified, and DO NOT include flights.

TRAVEL INSURANCE

It is your responsibility to organise suitable travel and health insurance. Although we strongly encourage you to do so, you acknowledge that Sky-lab is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially or otherwise.

SKY-LAB CANCELLATIONS DEFINITIONS

“Cancellation” is defined as not attending your scheduled retreat, including postponing or rescheduling. “You” refers to the guest booking a Sky-lab retreat. “We” refers to Sky-lab. It is your responsibility to read and understand our cancellation policy before making a reservation. Naturally, no one books with the intention of cancelling or postponing their retreat, but unexpected things do happen, so please consider purchasing travel cancellation insurance.

TRAVEL CANCELLATION INSURANCE

Depending on the policy and conditions, travel cancellation insurance may pay for some or all cancellation fees. Strictly for informational purposes and not to be relied upon, with most agencies, this type of insurance must be purchased within 14 days of making your reservation to optimise your level of protection.

GUEST CANCELLATION POLICY

Depending on when you cancel, cancellation fees may apply. Fees are determined by the following schedule (“the Cancellation fee schedule”):

  • If you cancel 100 days or more before your retreat start date, you will be refunded (less any bank or exchange fees) the full retreat amount minus your $850.00 AUD / $950.00 AUD non refundable deposit fee;

  • If you cancel 99 days or less before your retreat start date, you will forfeit your entire payment.

Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason. We do not offer credit for arriving late or leaving early. A guest can request to transfer to a future retreat 90 days or more before your retreat start date. Please note the future retreat must have availability.

CANCELLATION POLICY

If Sky-lab must cancel a retreat for any reason you’re entitled to transfer your full retreat payment to a future retreat (either scheduled or at some future time). Alternatively you may request a refund of your applicable payment, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your retreat. Sky-lab is not responsible for your expenses incurred in preparation for any cancelled retreat such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip. If a retreat is needed to be postponed due to circumstances out of our control you will be provided with your choice of a place on the new event date or a 100% credit voucher.

PASSPORTS, VISAS & DOCUMENTS

It is the responsibility of each participant to obtain a valid passport, visa(s) and necessary certificates for any country to be visited in connection with a Sky-lab retreat.

THIRD PARTIES

Sky-lab holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on a retreat as compared with the advertised nature of the service.

GENERAL WAIVER

You acknowledge that during a retreat you participate voluntarily in any and all activities arranged by the retreat organisers, and insofar as legally permissible, surrender your right to any cause of action against Sky-lab arising from any loss or damage to person or property that occurs during a retreat. Sky-lab is not responsible for any loss, damage, cost, expense or other liability whatsoever incurred by you or a member of your party arising out of:

  • Injury, or accident or death; 

  • Loss or delay of baggage or other property; and / or 

  • Any delay, inconvenience, loss of enjoyment, or frustration, whether physical or mental resulting from, but not limited to, any of the following factors: 

  • the act or omission of any party including Sky-lab or its employees; 

  • mechanical breakdown, government actions, weather or any other factor/s beyond our control 

  • your failure to read information provided and / or follow instructions including but not limited to obtaining sufficient travel protection & health insurance, and providing correct & complete personal, health and travel information 

  • your cancellation and / or change of any travel services; and / or 

  • your medical or health problems or physical disabilities.

PHOTO/VIDEO RELEASE FORM

During the retreat we may capture some of our classes, experiences or workshops in photos and video. Once cleared by you to publish this notice is to state: I hereby grant to Sky-lab the absolute and irrevocable right and unrestricted permission to use photographic portraits / images / videos in which I feature that are taken during the course of the retreat to use / republish / copyright, etc. for commercial use in association with Sky-lab’s business. I hereby release and discharge Sky-lab from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

RETREAT PARTICIPATION AGREEMENT

DEFINITIONS
We / Us / Our: Sky-lab (and any other applicable associated party)
You / Your / I / Me / My / He / She: The guest booking a retreat offered by Sky-lab
Cancel / Cancellation: Not attending your scheduled retreat, including postponing or rescheduling.
Retreat: The service offered by Sky-lab, being an arranged trip to an agreed upon destination, whereby Sky-lab offers customers the option to participate in such activities as aerial yoga and indoor / outdoor fitness activities (non-exhaustive)

LIABILITY WAIVER AND ASSUMPTION OF RISK
In consideration of the services of Sky-lab, their agents, owners, officers, volunteers, participants, employees, service suppliers and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “Sky-lab”), I hereby agree to release, indemnify, and discharge Sky-lab on behalf of myself, my children, my parents, my heirs, executors, administrators, assignees, personal representatives and estate as follows:

A. I acknowledge that sporting activities and traveling entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, and / or to third parties. I understand that such risks are inherent in the nature of retreats like the one in which I am participating with Sky-lab, and simply cannot be eliminated without jeopardising the essential qualities of the activity. My participation in all retreat activities is purely voluntary and so I expressly agree to assume all the risk of injury and / or damage while participating in all activities offered during the Sky-lab retreat. I also acknowledge that any eventuality of the same risks are not grounds for a refund or discount. Furthermore, I accept that whilst Sky-lab’s guides, instructors and / or other representatives endeavour to ensure the safety of all retreat participants (including myself), they are not infallible: they might be unaware of a participant's fitness or abilities; they might misjudge the weather, the elements, or the terrain; they may give inadequate warnings or instructions in the circumstances; and the equipment being used might malfunction.

B. Accordingly, I agree that I am participating voluntarily in any and all activities, risks, and use of the accommodations, and hereby assume all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss of personal property.

C. Furthermore, I expressly agree and promise to accept and assume all of the risks existing in the specified activities, with knowledge that the risks of participating in such activities include, but are not limited to:

    • being hit by the board, other surfers or their boards 

    • hitting the bottom of the ocean 

    • exhaustion, dehydration or sunburn 

    • exposure to poisonous and/or carnivorous sea creatures 

    • accidental drowning. 

    • the consequences of which could include, but are not limited to, broken bones, cuts, bruises, abrasions, concussions, internal injuries and even death.

D. I certify that I have adequate travel protection insurance should I need to cancel or change my travel plans & health insurance to cover any injury or damage I may cause or suffer while participating on any of the retreat activities or, in the event I don’t, I agree to bear the costs of such injury and / or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have, even where exacerbated by the activities and / or conditions of the retreat.
 
E. I understand that weather, water, and surf conditions are beyond the control of Sky-lab and its agents. Other natural elements such as reptiles, rodents, insects, and micro-organisms such as bacteria and viruses are also an inherent risk on a Sky-lab retreat and are not grounds for a refund or discount.
 
F. I understand that in the event that I was injured or to become ill, Sky-lab or one of their representatives may endeavour to provide me with medical, travel or other assistance, but members of Sky-lab and associated parties are not professionals in such areas and therefore the quality of any assistance of this kind is not guaranteed. I waive any claim for loss or damage against Sky-lab or any associated party in cases where assistance (provided or attempted) inadvertently worsens my condition.
 
G. I understand that it is my own responsibility and not that of Sky-lab to become aware of any applicable differences in the law of my own Country and the law of the Country in which the retreat is held. If I am fined, convicted, charged, or otherwise legally penalised for an illegal act during the retreat, I acknowledge that I waive any claim against Sky-lab or any associated party for failing to inform me of any relevant differences in laws
 
H. I acknowledge that I have full discretion regarding my decision to consume alcohol during the retreat. I further acknowledge that if any loss or damage results, directly or indirectly, from my consumption of alcohol, I waive any recourse or cause of action against Sky-lab, whether perceived endorsement or acquiescence of my alcohol consumption is present or not..
 
I. I hereby voluntarily release, forever discharge, and agree to indemnify and hold legally blameless Sky-lab, its officers, employees and suppliers against all legal causes of action in all legal jurisdictions, including with respect to loss, damage or expense, including legal fees or other expenses that may be incurred as a result of any such claim for loss or damage whether valid or not, including any such claims which allege negligent acts or omissions of Sky-lab.
 
J. Should Sky-lab or anyone acting on their behalf be required to incur legal fees and costs to enforce this agreement, I agree to indemnify them for all such fees and costs.
 
L. Should Sky-lab or anyone acting on their behalf incur legal fees, costs or damages as a result of my actions, whether illegal, improper or otherwise, I agree to indemnify them for all such fees, costs and damages.
 
M. I understand that Sky-lab takes no responsibility for the conduct of guests and will not be held liable for any loss or damage to person or property caused by another guest.
 
N. I acknowledge that, should I engage in improper conduct toward any other guest, member of Sky-lab staff or any other person or party, it becomes the sole and unqualified discretion of Sky-lab as to whether I am permitted to have any further participation in the retreat. In the event that I am disqualified from further participation, I understand that I forfeit my full retreat fee and have no right or recourse against Sky-lab to recover same.

By accepting this document, I acknowledge that if I incurs injury, loss or damage (to person or property) during my participation on a retreat, I can be found by a court of law to have waived my right to maintain a lawsuit against Sky-lab on the basis of any claim from which I have released them herein. I acknowledge that, in part, the purpose of this Participation Agreement is for me to certify that Sky-lab and all associated parties (as per the construction of this Agreement) are released from any responsibility for any loss, mishap, accident, injury or death that may occur during my participation a Sky-lab Retreat.
